Criminal/Traffic

If you are arrested, you should immediately invoke your right to an attorney. Tell the police that you want to call your attorney. You should also remain silent as any verbal or written statements that you make maybe used as evidence to prosecute you. What is an arrest? You have been arrested when a police officer or citizen takes you into custody or restrains you physically or verbally. You may be held to answer for a crime or an offense.

You may be taken into custody immediately or be given an appearance ticket. If you are detained, in most cases, an attorney will be able to arrange your release and posting of a bail bond or obtaining a court ordered release. It must be remembered that the period of time immediately following an arrest is often the time that is very critical. Police use this time to their advantage to interrogate the arrested individual and obtain incriminating statements. Remember, be calm, remain silent and ask for an attorney.
